On 5 May 2008 New Zealand launched the Immigration Advisers Authority requiring compulsory registration for persons intending to give immigration advice. The Migration Agents Registration Authority (MARA) is a body formed by the Department of Immigration & Citizenship for the purpose of regulating the provision of immigration advice in Australia. The MARA provides a safeguard for persons intending to migrate to Australia in ensuring that they be a Registered Migration Agent. In Australia a lawyer is unable to provide advice in relation to immigration law unless they are a Registered Migration Agent with the MARA. All Registered Migration Agents in Australia are bound by the MARA Code of Conduct, must maintain professional indemnity insurance and a library of immigration law. The MARA website provides a listing of current agents and whether any sanctions or disciplinary proceedings are currently on foot in relation to them at www.themara.com.au. In establishing the Immigration Advisers Authority in New Zealand, consultation was made with the MARA as to its practices and experience in the regulation of immigration advice in Australia.
