You may be able to apply for a partner visa, which allows your Australian (or eligible New Zealand) partner to sponsor you for migration to Australia.

Who is a partner?
A partner can be a:
- fiancé;
- husband or wife; or
- defacto spouse (heterosexual or same-sex) i.e. living together.
Which visa should I apply for?
There are three types of partner visas:
Prospective Spouse – Fiance Visa
Spouse/Partner Visa – Married or Defacto Partner
Interdependent Partner Visa – Same Sex Partner
Prospective Spouse – Fiance Visa
This visa allows your Australian permanent resident or citizen partner or eligible New Zealand citizen partner (“Australian Partner”) to sponsor you as their fiancé.
There are three stages to this visa.
The first stage allows the Australian Resident to sponsor you to come to Australia on a temporary visa. The purpose of this visa is to allow you to marry your Australian Partner in Australia. This visa must be applied for outside Australia and in your current country of residence.
In order to satisfy the criteria for the grant of this visa you must be able to demonstrate, amongst other things, that you have a committed relationship and intend to marry your Australian Partner.
Once you have been granted your temporary Fiancé Visa and arrive in Australia you must marry your Australian Partner within 9 months of your arrival.
Upon marriage in Australia you can then apply for the Temporary Partner Visa, which is the second stage of the process, further outlined below.
During this time you will be granted unrestricted work rights, you are eligible for limited medicare cover and can leave and re-enter Australia at your will.
The Temporary Partner Visa allows you to remain in Australia temporarily for at least two years. Once two years has passed from the date of your application for the Temporary Partner Visa, that is to say not from the date it was granted but the date that you applied for the visa, and if you are still in your married relationship, then you will be eligible to apply for the Permanent Partner Visa. This is the third stage of the process and is the application for permanent residence in Australia.

Spouse/Partner Visa
A spouse or partner visa allows your Australian permanent resident partner or citizen or eligible New Zealand citizen partner (“Australian Partner”) to sponsor you for migration to Australia.
There are two stages to this visa.
The first stage involves applying for a Temporary Partner Visa.
In order to satisfy the criteria for the grant of this visa you must be able to demonstrate, amongst other things, that you are in a committed exclusive partner relationship. You must also be living together and in the case of a defacto relationship this must be for at least twelve months prior to the time of your application.
This visa, once granted, allows you to remain in Australia for at least two years. During this time you will be granted unrestricted work rights, you will be eligible for limited medicare cover and can leave and re-enter Australia at your will.
Once two years has passed from the date of your application for the Temporary Partner Visa, that is to say not from the date it was granted but the date that you applied for the visa, and if you are still in your partner relationship, then you will be eligible to apply for the Permanent Partner Visa. This is the second stage of the process and is the application for permanent residence in Australia.
The application for the Permanent Partner Visa is simply a refresher of your Temporary Partner Visa and involves demonstrating that you have maintained your partner relationship during the preceding two years.
Once granted your Permanent Partner Visa you are given a five year permanent residence visa, which allows you to reside permanently in Australia.

Interdependent Partner Visa – Same Sex Partner
This type of visa is specifically for couples in same sex relationships. An interdependent partner visa allows your Australian permanent resident or citizen partner or eligible New Zealand citizen partner (“Australian Partner”) to sponsor you for migration to Australia.
There are two stages to this visa.
The first stage involves applying for a Temporary Interdependent Partner Visa.
In order to satisfy the criteria for the grant of this visa you must be able to demonstrate, amongst other things, that you are in a committed exclusive partner relationship. You must also be living together in a defacto relationship for at least twelve months prior to the time of your application.
This visa, once granted, allows you to remain in Australia for at least two years. During this time you will be granted unrestricted work rights, you are eligible for limited medicare cover and can leave and re-enter Australia at your will.

How can Christie David Immigration help you?
Although you may be in a partner relationship, the Department of Immigration’s criteria for partner visas is not as simple as it sounds. The criteria requires more than simply submitting a copy of your marriage certificate and a few supporting statements from your friends and family. There are detailed requirements that must be satisfied in order to demonstrate that you have what the Department of Immigration considers a partner relationship to be.
The Department of Immigration is bound by legislation that defines a partner relationship. The Department of Immigration also refers to policy and guidelines in making its decision as to whether you meet the criteria for the grant of a partner visa. In most cases, applicants make the error of following only the forms that are provided on the Department of Immigration’s website. These forms do not address the criteria of the legislation, the policy and guidelines that the Department of Immigration must consider in making its decision.

We will provide you with guidelines for the letters you must each write to the Department of Immigration regarding your relationship, the letters and statements your friends and family must provide as well as a list of all the documents that the Department of Immigration considers to be good evidence of a partner relationship.
We request that you send us draft versions of your letters to the Department of Immigration so that we may review them and provide you with feedback. It is also advisable to stay in touch with us whilst you are collecting your documentation. We are always available to answer any questions you may have, as basic as they may seem to you they may be quite significant in immigration terms.
Once you have collected all of your information and documentation we will review it and when we are satisfied that you have collected sufficient evidence of your relationship we will prepare a detailed legal submission to the Department of Immigration. The legal submission demonstrates how you meet the criteria for the grant of the visa and addresses immigration legislation, policy and guidelines.
We will also complete your forms electronically and you will need to sign them before we finally submit your application to the Department of Immigration.
